Sisters file suit against brother regarding sale of Winter Springs property

ORLANDO – Two sisters have filed suit against their brother regarding the sale of their late mother's home.

Elizabeth A. Cromwell and Julie Cromwell Johnson filed a complaint on May 25 in the 9th Judicial Circuit Court of Florida - Orange County against John B. Cromwell alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiffs allege that on July 1, 2013, the Winter Springs home of their late mother was distributed to Elizabeth Cromwell for the purpose of calculating her one-third share of the estate of their mother. The suit states the defendant requested the plaintiff to sell the home to him and entered an agreement with plaintiffs to pay Elizabeth Cromwell $130,000 for the home, $10,000 to Julie Cromwell Johnson and equally divide proceeds exceeding $140,000 to all parties.

The plaintiffs hold John B. Cromwell responsible because the defendant allegedly refused to account for the net proceeds upon the sale of the property and refused to pay plaintiffs each their one-third share of the net proceeds.

The plaintiffs request a trial by jury and seek judgment against the defendant, accounting of the net proceeds, compensatory damages, interest and costs. They are represented by Jed Berman of Infantino and Berman in Winter Park.
