Pinellas County property buyers allege owners failed to disclose issues with property

CLEARWATER – Buyers of a Pinellas County property allege that the previous owners failed to disclose water leaks at the property.

Raymond Scherzer Jr. and Royce Scherzer filed a complaint on June 22 in the 6th Judicial Circuit of Florida - Pinellas County against Steven Peabody and Mary Jane Peabody alleging breach of written contract for sale of real property.

According to the complaint, the plaintiffs allege that on March 31, 2016, they took possession of the real property they bought from defendants. As the rainy season began, they allege they experienced leaks throughout the property and have been damaged. The plaintiffs hold the Peabodys responsible because the defendants allegedly failed to make an accurate disclosure statement or amended disclosure statement.

The plaintiffs seek damages of more than $15,000, court costs, attorney's fees, interest and such other relief as is just and reasonable. They are represented by Joseph W. Etter IV of Englander Fischer LLP in St. Petersburg.
