Payment from American Integrity Insurance Co. sought from Orlando property owner

ORLANDO – An individual claims that her insurer has failed to pay the amounts she requested in a claim for property damages.

Joanne Hochhauser Ervin filed a complaint on May 23 in the 9th Judicial Circuit Court of Florida - Orange County against American Integrity Insurance Co. of Florida alleging breach of contract.

According to the complaint, the plaintiff alleges that on May 25, 2016, while her Orlando property was insured under a homeowner's insurance policy, it sustained a covered loss for water damage due to a leaking pipe. However, despite efforts of plaintiff to furnish timely notice of covered loss, the defendant allegedly refused to pay either part or all of plaintiff's claim. 

The plaintiff holds American Integrity Insurance Co. of Florida responsible because the defendant allegedly failed to establish that it had reasonable proof that it was not responsible for the payment of plaintiff’s damages and/or loss and has failed to pay the requested amounts for repairs and/or replacement plus applicable interest.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, interest, attorney's fees, costs and other relief that the court deems just and proper. She is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
