Winter Garden woman claims water damages should be covered under homeowner's policy

ORLANDO – A Winter Garden property owner alleges her insurer wrongfully denied coverage for water damages.

Marjorie Thenor filed a complaint on May 17 in the Orange Circuit Court against Liberty Mutual Fire Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 24, while her property was insured under a homeowner's insurance policy, it sustained a covered loss for water damage. However, despite efforts of plaintiff to timely file necessary forms and perform all obligations precedent to recover under the policy, the defendant allegedly denied the claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, interest, costs and attorney's fees. She is represented by David R. Heil of David R. Heil PA in Winter Park.
