Pembroke Pines property owners seek payment for damages from Citizens Property Insurance

FORT LAUDERDALE – An insurer is accused of failing to provide payment for damages to a Pembroke Pines property.

Gangadhar Senapati and Indu Senapati filed a complaint on May 19 in the 17th Judicial Circuit Court of Florida - Broward County against Citizens Property Insurance Corp. alleging breach of contract.

According to the complaint, the plaintiffs allege that on March 7, while their property was insured under a homeowner's insurance policy, it sustained a covered loss as a result of a roof leak. The suit states the defendant initially denied coverage for the loss, but later agreed to provide coverage.

The plaintiffs hold Citizens Property Insurance Corp. responsible because the defendant allegedly failed to acknowledge payment would be forthcoming and make any payment of insurance proceeds.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, plus interest, court costs, attorney's fees and further relief as the court deems just. They are represented by David Low of David Low & Associates PA in Fort Lauderdale.
