Consumer claims Classic Mazda/Holler Honda employee dropped hitch on foot, caused injury

ORLANDO – An Orlando automotive dealership is being accused of negligence by a woman who claims an employee injured her foot.

Stefanie Tejeda filed a complaint on May 15 in the 9th Judicial Circuit Court of Florida - Orange County against RCJ of Winter Park No. 2 LTD, doing business as Classic Mazda/Holler Honda, alleging that the business owner failed to provide a reasonably safe environment for its business invitees.

According to the complaint, the plaintiff alleges that on July 21, 2015, she visited defendant’s premises to get her vehicle repaired, when an employee dropped a hitch directly onto the top of plaintiff’s left foot. As a result of the careless act of defendant's employee, the plaintiff alleges she suffered bodily injury in and about her body and extremities, resulting in pain and suffering, disability, disfigurement, scarring, mental anguish, medical expenses, loss of earnings and aggravation of a previously existing condition. 

The plaintiff holds RCJ of Winter Park No.2 LTD, doing business as Classic Mazda/Holler Honda, responsible because the defendant allegedly created a hazardous condition for the plaintiff by inviting her into the actual repair shop area and failed to warn plaintiff of the danger and risk of entering the repair shop.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000 plus interest and costs. She is represented by James T. Lynch of Morgan & Morgan PA in Orlando.
