Shopper alleges falling bag of dog food at Winn-Dixie caused injuries

CLEARWATER – A Winn-Dixie shopper alleges he was injured by a bag of pet food.

David Paul Welbaum filed a complaint on May 16 in the 6th Judicial Circuit Court of Florida - Pinellas County against Winn-Dixie Stores Inc. alleging that the supermarket operator failed to properly train and supervise its employees on the proper stacking of large bags of goods.

According to the complaint, the plaintiff alleges that on Nov. 9, 2013, he was at defendant's Winn-Dixie store in Kenneth City when he was struck by a large bag of dog food that fell off a pallet. The plaintiff alleges he sustained serious and permanent injuries resulting in pain, disability, mental anguish, medical expenses and loss of ability to earn money. 

The plaintiff holds Winn-Dixie Stores Inc. responsible because defendant's employee allegedly negligently wheeled an overloaded or improperly loaded bag of dog food close to the plaintiff.

The plaintiff requests a trial by jury and seeks judgment for damages against defendant, plus costs of the suit and all other issues. He is represented by Daniel C. Kasaris of Karikas & Kasaris PA in St.Petersburg.
