Man alleges Heritage Property & Casualty Insurance Co. failed to adequately cover water damage

FORT LAUDERDALE – A Coconut Creek homeowner alleges his insurer failed to pay a sufficient amount for damages to his property.

Delton Palmer filed a complaint on May 11 in the 17th Judicial Circuit Court of Florida - Broward County against Heritage Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Dec. 22, 2016, he sustained physical losses to his insured property caused by water/moisture damage. Although the defendant acknowledged coverage of losses and an all-risk policy was then in full force and effect, the defendant allegedly paid an inadequate amount to perform the repairs necessary. 

The plaintiff holds Heritage Property & Casualty Insurance Co. responsible because the defendant allegedly refused to honor the contractual coverage in the policy by failing to fully compensate plaintiff with the correct amount of benefits owed.

The plaintiff requests a trial by jury and seeks judgment against defendant, compensatory damages, interest, attorney's fees and costs. He is represented by Jeremy F. Tyler, W. Wyndham Geyer Jr., Andrew Fuxa and Hillary B. Cassel of Geyer Fuxa Tyler in Sunrise.
