Woman files suit against Coconut Creek property owners after fall on staircase

FORT LAUDERDALE – A Miami-Dade County woman alleges a poorly lit stairway at a Coconut Creek property caused her to fall.

Tracy Falcon filed a complaint on May 11 in the 17th Judicial Circuit Court of Florida - Broward County against Rossmoor Bahama Village Association Inc. and Wynmoor Community Council Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on March 19, 2016, she was on the premises of defendants' property as a guest of one of its residents, but despite her careful attempt to descend the stairway, she was caused to stumble and fall because of the dangerously inadequate illumination of the area. As a result, she alleges she sustained severe injuries, including disability, pain and suffering, aggravation of an existing condition and incurred medical expenses. 

The plaintiff holds Rossmoor Bahama Village Association Inc. and Wynmoor Community Council Inc. responsible because the defendants allegedly failed to maintain the lighting fixtures adjacent to the stairway and failed to regularly inspect the real property and its common elements.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, costs and further relief deemed proper. She is represented by Stephen J. Duane of Marvin S. Schulman PA in Weston.
