Man alleges he is entitled to damages under GEICO policy

CLEARWATER – A St. Petersburg man is seeking coverage from his insurer after an accident with an underinsured driver.

Frank Binsted Jr. filed a complaint on May 12 in the 6th Judicial Circuit Court of Florida - Pinellas County against GEICO General Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Nov. 29, 2016, he was severely injured when he was involved in a vehicular accident caused by the negligence of an uninsured motorist. Plaintiff alleges he is entitled to collect damages under his underinsured motorist policy with defendant in the amount of damages. The plaintiff holds GEICO General Insurance Co. responsible because the defendant allegedly failed and refused to make payments under the provisions of the insurance policy.

The plaintiff requests a trial by jury and seeks damages of more than $15,000, plus costs and interest and such other just and proper relief. He is represented by Jeremy S. Clark of Pearlman & Clark PA in St. Petersburg.
