Woman alleges damage to Safety Harbor property should be covered by insurance policy

Insurance 04

CLEARWATER – A Safety Harbor property owner claims her insurer wrongfully denied a loss covered by her policy.

Annette Toy filed a complaint on May 12 in the 6th Judicial Circuit Court of Florida - Pinellas County against Edison Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Feb. 25, plaintiff's insured property sustained considerable damage caused by sudden and accidental water loss.

The plaintiff holds Edison Insurance Co. responsible because the defendant allegedly refused to remit payment for the damages sustained by plaintiff and denied coverage for the same.

The plaintiff seeks judgment against defendant for all unpaid amounts due under the insurance policy, plus interest, costs and attorney's fees and such other just and proper relief. She is represented by Alejandro Felce of Felce Law in Orlando.
