CLEARWATER – Two Pinellas County residents allege they were injured when their vehicle was rear-ended in the county.
Lisa Hansen and Charles Papcke filed a complaint on May 11 in the Pinellas Circuit Court against Charles Braitling and GEICO General Insurance Co. alleging negligence.
According to the complaint, the plaintiffs allege that on July 29, 2016, they were driving along 49th Street and had slowed down their vehicle to a stop for traffic ahead. They allege the vehicle behind them was rear-ended by Braitling with such violent impact that it forced that vehicle into the rear of plaintiffs' vehicle. As a result of defendant's alleged carelessness, the plaintiffs claim they sustained bodily injuries and incurred damages including pain and suffering, disability, mental anguish and loss of earning capacity.
The plaintiffs hold Braitling and GEICO General Insurance Co. responsible because Braitling allegedly failed to obey traffic laws, failed to pay attention to the road and traffic while driving and that GEICO allegedly has failed to reach an agreement with the plaintiffs regarding compensation owed under an uninsured motorist policy.
The plaintiffs request a trial by jury and seek judgment against defendants for damages of more than $15,000, costs of proceedings and further relief as the court deems just. They are represented by Mark H. Wright and Jana L. Keenan of Jayson, Farthing, Skafidas & Wright PA in Tampa.
