CLEARWATER – The operators of Consulate Health Care of St. Petersburg are accused of failing to provide appropriate health care to a former resident.
Luz Villafane, as power of attorney for Monserrate Osuna Rodriguez, filed a complaint on May 10 in the 6th Judicial Circuit Court of Florida - Pinellas County against St. Petersburg Facility Operations LLC, CMC II LLC and Richard D. Parker citing Chapter 400 of the Florida statutes.
According to the complaint, the plaintiff alleges that her mother, Monserrate Osuna Rodriguez, was a resident of defendants' nursing home from July 8 to Nov. 13, 2015. However, throughout her residency, the plaintiff alleges Rodriguez was abused and neglected and suffered serious injuries, including a fractured hip.
The plaintiff holds St. Petersburg Facility Operations LLC, CMC II LLC and Richard D. Parker responsible because the defendants allegedly failed to provide adequate health care, protective and support services.
The plaintiff requests a trial by jury and seeks judgment against defendants for damages, plus attorney's fees, legal assistant's fees, costs and other appropriate and proper relief. She is represented by James M. Ragano of Stockham Law Group in Tampa.
