FORT LAUDERDALE – A homeowner alleges his property sustained a covered loss but that his insurer denied his claim.
Mickel Myers filed a complaint on May 3 in the 17th Judicial Circuit Court of Florida - Broward County against Homeowners Choice Property & Casualty Insurance Co. Inc. alleging breach of contract.
According to the complaint, the plaintiff alleges that on Sept. 22, 2016, his Margate property sustained a covered loss for water damage. The suit states the defendant denied coverage for the loss.
The plaintiff holds Homeowners Choice Property & Casualty Insurance Co. Inc. responsible because the defendant allegedly failed to acknowledge coverage for the loss, failed to acknowledge that payment would be forthcoming, and failed to make any payment of insurance proceeds.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages, plus interest, court costs, attorney's fees and other relief as the court deems just. He is represented by Anthony M. Lopez of Marin, Eljaiek & Lopez PL in Coconut Grove.
