Homeowners allege Universal Property and Casualty Co. failed to timely pay claim

FORT LAUDERDALE – The owners of a West Park resident allege their insurer has failed to either pay or deny their claim for water damage.

Newell and Berlinda Tucker filed a complaint on May 3 in the 17th Judicial Circuit Court of Florida - Broward County against Universal Property and Casualty Co. seeking damages.

According to the complaint, the plaintiffs allege that on Dec. 4, 2016, their property sustained a covered loss for water damage resulting from a burst water heater. The suit states the plaintiffs notified the defendant of the loss and that the defendant has not paid the claim or established that it is not responsible for the damages.

The plaintiffs hold Universal Property and Casualty Co. responsible because the defendant allegedly failed to timely pay the claim.

The plaintiffs request a trial by jury and seek judgment against defendant for damages, interest, attorney's fees and other relief the court deems just. They are represented by Michael Cecere of Cecere Santana PA in Sunrise.
