Tarpon Springs resident alleges it failed to properly train employees

CLEARWATER – A resident of a skilled care nursing facility alleges that she suffered mental and physical pain because of negligent care.

Alethia McDaniel filed a complaint on May 8 in the 6th Judicial Circuit Court of Florida - Pinellas County against LP Tarpon Springs LLC, doing business as Peninsula Care and Rehabilitation Center, and Ryan Dulski alleging negligence.

According to the complaint, the plaintiff alleges that in August 2015, she was admitted to the defendants' facility. She alleges the defendants failed to adequately assess her risk of skin breakdown and failed to prevent a stage four skin breakdown.

The plaintiff alleges the defendants failed to provide adequate number of employees to meet the needs and protect the rights of residents; failed to properly train, supervise, discipline, and retain employees; and failed to deliver the care and services to residents in accordance with prevailing standards of care for nursing home.

The plaintiff requests a trial by jury and seeks damages of more than $15,000, together with costs, prejudgment interest, and for any other relief the court deems appropriate. She is represented by Al Ferrera of Morgan and Morgan, Tampa, PA in Tampa.
