Uber passenger alleges motorist's negligent driving caused I-95 collision

FORT LAUDERDALE – An Uber passenger alleges he was injured when the car was rear-ended on Interstate 95.

Anthony Beneduce filed a complaint on May 1 in the 17th Judicial Circuit Court of Florida - Broward County against Dennis Griffin and James River Insurance Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 13, 2016, he was picked up by an Uber driver and was traveling on I-95 in Miami when the defendant rear-ended the driver's vehicle. The plaintiff alleges that he has suffered damages including disability, disfigurement, mental anguish, loss of earnings, medical expenses, and aggravation of a pre-existing condition. The plaintiff alleges he sustained further damage from James River Insurance Co.'s refusal to cover third-party loss against policy issued to Raiser LLC, which is a subsidiary of Uber. 

The plaintiff requests a trial by jury and seeks judgment against defendants, for damages in excess of $15,000, and interest. He is represented by Michael T. Lewenz of Zebersky Payne LLP in Fort Lauderdale.
