FORT LAUDERDALE – A Fort Lauderdale homeowner alleges that his insurer failed to fully compensate him for damages to his property.

Ernest J. Colabella, also known as Ernie Colabella, filed a complaint on April 27 in the 17th Judicial Circuit Court of Florida - Broward County against State Farm Florida Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Dec. 22, 2016, his insured property suffered substantial water damage from a plumbing failure. Although the defendant acknowledged the covered loss and issued payment of $300 for leak detection, the defendant has allegedly failed to fully compensate plaintiff for his property's damages.

The plaintiff requests a trial by jury and seeks judgment in his favor for damages of more than $15,000, together with interest, attorneys' fees, costs, and other relief as the court deems appropriate. He is represented by Valorie S. Chavin and James E. Mitchell of Shmuely & Willis PA in North Miami.
