Orange County residents allege Florida Peninsula Insurance Co. failed to pay claim

ORLANDO – The owners of a Rush Court, Orlando property allege their insurer has failed to pay their claim for damages.

Alfredo Rodriguez and Maria Miranda filed a complaint on May 8 in the 9th Judicial Circuit Court of Florida - Orange County against Florida Peninsula Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Dec. 10, 2016, their property, which was insured under a homeowners' insurance policy, sustained a covered loss as a result of a broken and/or leaking pipe. However, despite efforts of plaintiffs to furnished timely notice of covered loss, the defendant has yet to pay either part or all of plaintiffs' claim or establish that it is not reasonable for payment of the claim.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages, interest, attorney's fees, costs, and other relief that the court deems just and proper. They are represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
