Woman alleges property was damaged by water, insurer failed to pay claim

ORLANDO – An Orange County resident claims her insurer failed to pay her claim.

Lucila Hernaiz filed a complaint on May 8 in the 9th Judicial Circuit Court of Florida - Orange Count against Geovera Specialty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that on Oct. 25, 2016, her property, which was insured under a homeowners' insurance policy, sustained a covered loss for water damage due to a broken pipe, including damage to dwelling, other structures, personal property and loss of use. 

However, despite efforts of plaintiff to furnished timely notice of covered loss, the defendant allegedly has yet to pay either part or all of plaintiff's claim and establish proof that it is not responsible for the payment. 

The plaintiff seeks judgment against the defendant for damages, interest, attorney's fees, costs and other relief that the court deems just and proper. She is represented by Thomas J. Morgan Jr. of Morgan Law Group PA in Coral Gables.
