ORLANDO – A shopper at an Orlando grocery store claims she fell because it failed to warn of the condition of the floor.
Lucia Cuticone filed a complaint on May 3 in the 9th Judicial Circuit Court of Florida - Orange County against Publix Super Markets Inc. alleging negligence.
According to the complaint, the plaintiff alleges that on April 4, 2015, she slipped and fell on a liquid substance that had accumulated on the floor of defendant's premises. She alleges the incident caused her to sustain bodily injuries, pain and suffering, disability, aggravation of previously existing condition, medical expenses and lost wages.
The plaintiff holds Publix Super Markets Inc. responsible because the defendant allegedly failed to maintain and inspect the floor, failed to warn plaintiff of the dangerous condition of the floor, and failed to correct the unreasonably hazardous condition of the floor.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000 plus interest and cost. She is represented by Gregory S. Stark of Todd K. Miner PA in Orlando.
