Seminole County cyclist alleges he was injured by motorist

Car accident 03

CLEARWATER – A Seminole County couple alleges that the husband was struck by a motorist while riding his bicycle.

Barry and Denise Waldie filed a complaint on May 3 in the 6th Judicial Circuit Court of Florida - Pinellas County against Janeth and Ralph Starkey alleging negligence.

According to the complaint, the plaintiffs allege that on Sept. 13, 2015, Barry Waldie was riding his bicycle in a crosswalk when Janeth Starkey carelessly operated the vehicle she co-owned with Ralph Starkey so that it struck plaintiff's bicycle. As a result, plaintiff alleges he sustained serious bodily injury, disability, loss of earnings, aggravated his orthopedic and diabetic conditions, and incurred medical expenses. Additionally, Denise Waldie alleges she has been deprived of the comfort, services and consortium of her husband.

The plaintiffs hold Janeth and Ralph Starkey responsible because Janeth Starkey allegedly operated vehicle in a reckless manner and at an excessive speed and failed to stop at the crosswalk signal.

The plaintiffs request a trial by jury and seek judgment against defendants for damages of more than $15,000, plus costs of suit, interest, and further relief as the court deems just. They are represented by Mark D. Link and Steven P. Combs of Combs Greene PA in Jacksonville.
