Mall of the Millenia patron files suit alleging negligence after assault in parking lot

ORLANDO – An Orange County woman has filed suit against the operator of the Mall of the Millenia over allegations it failed to provide adequate security.

Nancy Horton filed a complaint on April 28 in the 9th Judicial Circuit Court of Florida - Orange County against Forbes Taubman Orlando LLC alleging negligence.

According to the complaint, the plaintiff alleges that on Jan. 26, she was walking towards her car in the Mall of the Millenia parking lot when she was assaulted, robbed and thrown to the ground. As a result of the incident, she alleges she suffered numerous injuries including a fractured shoulder that warranted emergency surgery, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life and expenses of hospitalization and treatment. 

The plaintiff holds Forbes Taubman Orlando LLC responsible because the defendant allegedly failed to employ adequate security guards, procedures, equipment, or other measures; failed to adequately light the parking lot to deter criminal attacks; and failed to warn its patrons of foreseeable safety concerns.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, litigation costs, and any other relief the court deems just. She is represented by Carrie Mendrick Roane of Barrett, Fasig & Brooks in Tallahassee.
