Widow files suit against Wyndham Orlando Resort, I Shops after husband's death

ORLANDO – A resident of Turkey alleges the negligence of a hotel and business in providing adequate security was the proximate and legal cause of the shooting death of her husband.

Kivilcim Diker, individually and personal representative of the estate of Osman Darcan, filed a complaint on April 27 in the 9th Judicial Circuit Court of Florida - Orange County against Wyndham Hotel Management Inc., doing business as Wyndham Orlando Resort, and I Shops LLC citing the Florida Wrongful Death Act Statute.

According to the complaint, the plaintiff alleges that on Sept. 8, 2016, she was visiting defendant's property with her husband when an assailant attacked her and shot and killed her husband in the parking lot of defendant's property.

The plaintiff holds Wyndham Hotel Management Inc. and I Shops LLC responsible because the defendants allegedly failed to provide reasonable security and failed to warn plaintiff of prior criminal activity.

The plaintiff requests a trial by jury and seeks judgment for damages of more than $15,000 against the defendant, together with court costs and interest. She is represented by Neal H. Hirschfeld of Greenspoon Marder PA in Fort Lauderdale.
