FORT LAUDERDALE – A Broward County couple allege their home was damaged by a plumbing problem and that their insurer's payment was inadequate to cover the damage.
Jessica and Ross Nochimson filed a complaint on April 24 in the 17th Judicial Circuit Court of Florida - Broward County against American Integrity Insurance Co. of Florida alleging breach of contract.
According to the complaint, the plaintiffs allege that on Aug. 11, 2016, while their property was actively insured by the defendant against certain losses, the property sustained water damages as a result of a plumbing leak. However, they allege the amount paid by the defendant was inadequate to perform all repairs necessary related to the covered loss.
The plaintiffs hold American Integrity Insurance Co. of Florida responsible because the defendant allegedly failed to timely and promptly pay the full amount due and owing under the policy for the covered loss.
The plaintiffs request a trial by jury and seek judgment against the defendant for damages, interest, court costs, attorney's fees and further relief as the court deems just. They are represented by David Low of David Low & Associates PA in Fort Lauderdale.
