Consumer claims Midland Funding wrongfully filed claim

TAMPA – A Sarasota County consumer alleges a debt collector wrongfully filed a complaint against her.

Toshia L. Lockerman filed a complaint on April 17 in the Tampa Division of the Middle District of Florida against Midland Funding LLC alleging violation of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on April 25, 2016, the defendant wrongfully filed a small claims complaint against her in Manatee County falsely alleging that she had a JCPenney credit card account through Synchrony Bank and resided in Manatee County. 

The plaintiff holds Midland Funding LLC responsible because the defendant allegedly threatened to enforce an illegitimate debt, falsely represented the character, amount or legal status of the alleged debt and used deceptive means to obtain information about the plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, attorney's fees and costs. She is represented by John P. Fleck Jr. of Law Office of John P. Fleck Jr. in Bradenton.
