ORLANDO – A man alleges he was injured in the parking lot of a retail/pharmacy store because of melted ice cream.
Brian Anderson filed a complaint on April 25 in the 9th Judicial Circuit Court of Florida - Orange County against Walgreen Co. and Othman Otto alleging negligence.
According to the complaint, the plaintiff alleges that on April 22, 2016, he was a guest at the defendants' store when he slipped and fell in melted ice cream in the parking lot within the premises of defendants' property. As a result of defendants' alleged negligence, plaintiff claims he suffered bodily injury, disfigurement, disability, mental anguish, incurred medical expenses, loss of earnings and aggravation of a pre-existing condition.
The plaintiff holds Walgreen Co. and Otto responsible because the defendants allegedly failed to have adequate staff on duty to regularly inspect and maintain the premises and failed to follow its own corporate policies on proper disposal and maintenance of dangerous conditions.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, plus interest and costs. He is represented by Varun Ramnarine of Morgan & Morgan PA in Orlando.
