FORT LAUDERDALE — A Broward County resident is suing Tower Hill Prime Insurance Company with claims that it refused to pay for damage from a roof leak.
Princeton Smith filed a complaint on April 21 in the Broward Circuit Court alleging that the insurer breached its duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that, on Nov. 28, 2016, while plaintiff's property was insured with the defendant, he suffered a covered loss from a roof leak that caused immediate physical interior damage to the property. The defendant did acknowledge coverage for the loss but refused to pay the full amount of insurance proceeds due.
The plaintiff holds Tower Hill Prime Insurance Company responsible because it allegedly failed to fulfill its obligations under the agreement by refusing to pay the full amount of damages for the loss.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages in excess of $15,000, plus statutory interest, court costs and attorneys' fees. He is represented by Pierre A. Louis of David Low & Associates PA in Fort Lauderdale.
