Prepared Insurance allegedly failed to pay for water damage

CLEARWATER — A Palm Harbor homeowner is suing Prepared Insurance Company, citing alleged breach of contract for refusing to cover water damage.

Margery Schultz filed a complaint on April 24 in the Pinellas Circuit Court against Prepared Insurance Company alleging that it breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that, on Jan. 1, 2017, she sustained loss to her property and structures from a water leak while insured under the defendant. However, the plaintiff claims the defendant refused to fully pay for damages despite knowing that it is required to do so under the terms of the policy. 

The plaintiff holds Prepared Insurance Company responsible because it allegedly failed to provide coverage under the insurance policy and failed to pay promptly the amounts due, thereby breaching the contract of insurance.

The plaintiff requests a trial by jury and seeks judgment against defendant, pay in full for the contract of insurance, actual and compensatory damages, interest, costs of action, attorneys' fees and further relief as the court may deem appropriate.
