Trinity Health employee alleges claim for disability benefits was unlawfully denied

MIAMI – An employee at Trinity Health alleges his claim for disability benefits was denied without a full and fair review.

John Bailey filed a complaint on April 11 in the U.S. District Court for the Southern District of Florida against Hartford Life and Accident Insurance Co. alleging that the defendant violated the Employment Retirement Income Security Act.

According to the complaint, the plaintiff alleges that since May 10, 2013, plaintiff has been disabled and prevented from performing the essential duties of his job. After becoming disabled, the suit states he filed a claim under his employer's long-term disability insurance plan but was denied.

The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly failed to pay benefit payments to those entitled under the terms of the long-term disability plan, failed to provide a prompt and reasonable explanation of the basis relied upon under the terms of the long-term disability plan and failed to provide a full and fair review of the policy owner's claim.

The plaintiff requests a trial by jury and seeks payment for disability benefits, pre- and post-judgment interest, all costs and attorneys' fees incurred, and such other and further relief as the court deems just and proper.
