Carnival passenger alleges he was injured because of slippery deck

Cruise 08

MIAMI – A paying passenger of a cruise ship alleges he was injured when he slipped and fell on slippery surface on the ship.

Ted Dukes filed a complaint on Feb. 21 in the U.S. District Court for the Southern District of Florida, Miami Division against Carnival Corp. alleging negligence.

According to the complaint, the plaintiff alleges that in Feb. 23, 2016, while aboard the Carnival Breeze vessel, plaintiff was severely injured when he slipped and fell on a wet, slippery and/or hazardous flooring surface in or around Guy's Burger Joint on the Lido Deck. As a result, Dukes claims he suffered physical injuries, lost wages and incurred medical expenses.

The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to maintain the area in a clean and dry condition, failed to close off and/or place warning signs on or around the wet and slippery areas on the deck and failed to have a non-slip or non-skid flooring surface.

The plaintiff requests a trial by jury and seeks judgment for all damages recoverable under the law and other relief to which the court deems proper. He is represented by Jason R. Margulies and Jacqueline Garcell of Lipcon, Margulies, Alsina and Winkleman PA in Miami.
