TAMPA – A Hillsborough County man alleges he was terminated in retaliation for his complaints about illegal practices regarding maintenance at an apartment complex.
Jose Oliva filed a complaint on April 12 in the Tampa Division of the Middle District of Florida against FL Harbour Walk LLC and Strategic Outsourcing Group Inc. citing the Fair Labor Standards Act and Florida's Private Whistleblower Act.
According to the complaint, the plaintiff worked as a maintenance technician for the defendants at Harbour Walk Apartments in Tampa from 2015 to 2016. He alleges that he was not allowed to properly fix maintenance issues and could only provide temporary repairs, and was terminated when he complained about this practice.
The plaintiff holds FL Harbour Walk LLC and Strategic Outsourcing Group Inc. responsible because the defendants also allegedly failed to keep or provide an accurate record of its employees' hours worked and failed to compensate its employees of overtime wages.
The plaintiff requests a trial by jury and seeks judgment against defendants, reinstatement, liquidated damages, prejudgment interest, attorney’s fees, costs and further relief the court deems just. He is represented by Cynthia Gonzalez and Luis R. Amadeo of Cynthia Gonzalez PA in Tampa.
