Citizens Property Insurance Corp. alleged to have failed to fully pay for tree damage

CLEARWATER – The owner of a St. Petersburg property alleges its insurer failed to pay damages from a fallen tree.

MDMitchell LLC filed a complaint on April 17 in the 6th Judicial Circuit Court of Florida - Pinellas County against Citizens Property Insurance Corp. alleging breach of insurance policy.

According to the complaint, the plaintiff alleges that on Jan. 22, it sustained loss, destruction and physical damage to its property when a tree fell onto the roof while the policy was still in full force and effect. The plaintiff holds Citizens Property Insurance Corp. responsible because the defendant allegedly breached insurance policy contract by failing to pay the full insurance proceeds.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $15,000, full costs of repair, prejudgment interest, court costs, expert fees and attorney's fees. It is represented by Hans Peter B. Haahr of Haahr Law Group PL in St. Petersburg.
