ORLANDO – Current employees have filed a class-action lawsuit against a Lake Buena Vista restaurant chain over allegations they were not paid a minimum wage.
Corwyn Cullins, Cindy Stavisky and Guillermo Masias filed a complaint individually and on behalf of others similarly situated on April 5 in the 9th Judicial Circuit Court of Florida - Orange County against Levy World Limited Partnership, doing business as Fulton’s Crab House, citing the Florida Minimum Wage Act and the Florida Constitution.
According to the complaint, the plaintiffs allege that they and other similarly situated servers have suffered monetary damages as a result of the wrongful conduct of the defendant to improperly utilize the tip credit instead of paying the regular minimum wage. The plaintiffs hold Levy World Limited Partnership responsible because the defendant allegedly failed to compensate plaintiffs the applicable state minimum wage for all hours worked, benefited at the detriment of plaintiffs, and improperly applied the tip credit.
The plaintiffs request a trial by jury and seek judgment in favor of the plaintiffs, liquidated damages, interest, attorneys’ fees, costs and disbursements, and further relief as the court deems just. They are represented by Arielle K. Brandt of Cohen Grossman, Attorneys at Law in Maitland.
