Man sues business partner in Lexxus health care staffing company

FORT LAUDERDALE — A Broward County resident is suing Lexxus Healthcare LLC, Lexxus Healthcare Services Group LLC and Scott C. Watson, citing alleged conversion, retaliation, breach of fiduciary duty and unjust enrichment.

Jonathan Levy filed a complaint on April 4 in the Broward Circuit Court against the defendants alleging that they breached their duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he suffered economic injury as a result of entering into a partnership with defendant Watson. Subsequently, plaintiff claimed he discovered that Watson was using corporate funds for personal use. Watson then allegedly retaliated against plaintiff by refusing to provide him with any financial information and threatening to lock him out of the business or buy him out. The plaintiff holds Watson and the defendant companies responsible because Watson allegedly refused to provide plaintiff any access to the business books and records, which is against his right as an equal partner, and misappropriated the assets of the company for his own benefit.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages in excess of $15,000, plus costs, interest, attorney's fees and further relief as is deemed proper. He is represented by Michael C. Foster, Kristopher E. Aungst and Jesse R. Cloyd of Tripp Scott PA in Fort Lauderdale.
