FORT LAUDERDALE – A couple alleges their insurer undervalued the costs of repairs needed due to water damage at a Weston property.
Dr. Richard and Shelley Chermak filed a complaint on March 29 in the Broward Circuit Court against Homeowners Choice Property and Casualty Insurance Co.
According to the complaint, the plaintiffs allege that on July 13, 2016, they suffered water damage to their insured Weston property because of a plumbing failure that necessitated repairs. The suit states that the defendant admitted coverage for the loss and made a minimal payment, but it undervalued the cost of repair and refused to acknowledge the full scope of necessary repairs.
The plaintiffs hold Homeowners Choice Property and Casualty Insurance Co. responsible because the defendant allegedly refused to pay the full value of the claim and failed to properly adjust the claim to cover total damages.
The plaintiffs request a trial by jury and seek judgment against defendant for general damages, including prejudgment interest, attorney's fees and costs. They are represented by Cameron W. Wilson of Wilson Law Offices PL in Miami.
