FORT LAUDERDALE – A homeowner alleges his insurer failed to cover his claim for damages to his property due to water damage.
Terrence McClover filed a complaint on March 23 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Safepoint Insurance Co. alleging breach of contract.
According to the complaint, the plaintiff alleges that on June 12, 2016, a plumbing line failed that resulted in water damage to interior walls, cabinetry, baseboard and paint in his home. The plaintiff alleges he provided timely notice to the defendant regarding the loss and complied with all conditions required to get the reimbursement, but the defendant failed to cover the damage.
The plaintiff holds Safepoint Insurance Co. responsible because the defendant allegedly failed to timely evaluate the policy and pay the benefits owed to plaintiff.
The plaintiff requests a trial by jury and seeks judgment for all damage to his residence with interest on overdue payments, reasonable attorney's fees, court costs and any other relief deemed just and equitable. He is represented by Leo A. Manzanilla of M.S.P.G. Law Group PA in Coral Gables.
