Photographer alleges StartupBros unlawfully used photo

ORLANDO – A Palm Harbor business is accused of unlawfully using a photograph to advertise its business.

Andrew Takano filed a complaint on April 6 in the U.S. District Court for the Middle District of Florida against StartupBros LLC alleging copyright infringement.

According to the complaint, the plaintiff created a photograph called "Road to Terlingua" and registered it with the Register of Copyrights in 2014. The plaintiff holds StartupBros LLC responsible because the defendant allegedly copied the plaintiff's copyrighted work to use it advertise its business without his permission.

The plaintiff requests a trial by jury and seeks judgment against the defendant, actual and statutory damages, attorneys' fees, costs of suit, and further relief as the court deems just. He is represented by Joel B. Rothman and Kevin E. Cudlipp of Schneider Rothman Intellectual Property Law Group PLLC in Boca Raton.
