Motorist alleges State Farm failed to provide benefits after collision

ORLANDO – An Orange County motorist alleges her auto insurer failed to fulfill its obligations after a collision.

Nancy Hernandez Rodriguez filed a complaint on March 20 in the 9th Judicial Circuit Court of Florida - Orange County against State Farm Mutual Automobile Insurance Co. alleging that the insurer breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that on Aug. 24, 2016, she was injured in an accident on Pershing Avenue in Orlando that involved an uninsured motorist. The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly failed and refused to provide underinsured/uninsured insurance benefits, and failed to fulfill its obligations under the insurance policy issued to plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant, for damages, interest, costs and further relief as the court may deem proper. She is represented by Scott D. Santos of Pardy & Rodriguez PA in Orlando.
