Macaluso's & Co. Inc. alleged to have not paid minimum wages

MIAMI – A former server for a Miami-Beach restaurant alleges she was not paid for all the hours that she worked during her employment.

Julia Muldowney filed a complaint on April 7 in the U.S. District Court for the Southern District of Florida against Macaluso's & Co. Inc., Macalusos Inc. and Michael D'Andrea citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for the defendants as a server from June 9 to July 28, 2015, for an average of 37 hours per week. The plaintiff holds Macaluso's & Co. Inc., Macalusos Inc. and D'Andrea responsible because the defendants allegedly failed to pay minimum wages to the plaintiff because of an illegal tip pool.

The plaintiff requests a trial by jury and seeks to enjoin the defendants, award reasonable attorney's fees and costs plus any relief as the court may deem just and proper. She is represented by Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
