TAMPA – A Rotunda business claims an Arkansas company unlawfully copied its infant pacifier clip design.
PBnJ Baby Inc. filed a complaint on April 4 in the Tampa Division of the Middle District of Florida against Copia Partners LLC alleging patent infringement.
According to the complaint, the plaintiff alleges that it is the owner of the '965 patent titled Tethered Clip and has been marketing and selling the clip since 2013. The plaintiff holds Copia Partners LLC responsible because the defendant allegedly caused consumer confusion through manufacture and distribution of an identical or similar product as plaintiff's.
The plaintiff requests a trial by jury and seeks judgment against defendant, permanent injunction, award of damages, accounting of wrongful profits and payment to plaintiff, interest, costs of action, attorneys' fees and further relief as the court deems just.
