Former welder alleges Planexhaust Corp. failed to pay overtime

MIAMI – A laborer claims a Tamarac plane exhaust system parts retailer misclassified him and failed to pay overtime.

Marvin Figueroa filed a complaint on April 4 in the U.S. District Court for the Southern District of Florida against Planexhaust Corp. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for the defendant from February 2013 to April 2016 as a welder/fabricator and worked between 45-50 hours per week. The plaintiff holds Planexhaust Corp. responsible because the defendant allegedly misclassified plaintiff in direct violation of the labor code, failed to compensate plaintiff for all hours worked, failed to pay overtime and failed keep accurate records.

The plaintiff requests a trial by jury and seeks judgment against defendant and award plaintiff the greater of $5,000 or the sum of actual damages, costs and attorney's fees and other relief as the court deems necessary.
