Orange County resident alleges Universal Property & Casualty Insurance Co. breached contract

ORLANDO – An Orange County resident alleges her insurer failed to pay the full amount of benefits due to her after her property suffered water damage.

Barbara Bain filed a complaint on March 24 in the 9th Judicial Circuit Court of Florida - Orange County against Universal Property & Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiff alleges that her residence was damaged by water on March 25, 2016, while her insurance policy was in full force and effect. The suit states the defendant's representative estimated the damage at $4,083.38, as opposed to the estimated $17,431.80 done by plaintiff. The plaintiff holds Universal Property & Casualty Insurance Co. responsible because the defendant allegedly failed to pay plaintiff’s property damage claim on a timely basis, and refused to pay the full amount of benefits due to plaintiff under the policy.

The plaintiff seeks judgment and award against defendant of compensatory damages, prejudgment interest, costs of action, attorney’s fees and costs, and further relief as the court may deem proper. She is represented by Travis D. Watson of Travis Watson PA in Luz.
