Broadway Kosher Style Restaurant server alleges she was not paid a minimum wage

FORT LAUDERDALE – A server for a South Florida restaurant alleges she was not paid minimum wage during her employment.

Cynthia Anne Hein filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida against Energy Resource Services Inc., doing business as Broadway Kosher Style Restaurant, Justin T. Kennelly and John B. Kennelly alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for the defendants as a server without being the full and proper minimum wages as required by the FLSA. The plaintiff holds Energy Resource Services Inc., Justin T. Kennelly and John B. Kennelly responsible because the defendants allegedly willfully refused to pay her legally entitled wages.

The plaintiff seeks unpaid minimum wages, liquidated damages, interest, costs and attorneys’ fees and such other remedy as the court deems just and appropriate. She is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
