Woman alleges crewmember on cruise ship caused metal tile to fall on her

MIAMI – A New Jersey woman alleges she was injured on a cruise ship because of a ceiling tile.

Janine Dayeh filed a complaint on April 3 in the U.S. District Court for the Southern District of Florida, Miami Division against MSC Cruises (USA) Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on May 22, 2016, she was injured because a crewmember of the defendant pushed the tile during inspection of a ceiling and caused the metal ceiling panel to fall and land onto waiting passengers, including plaintiff. The plaintiff holds MSC Cruises (USA) Inc. responsible because the defendant allegedly failed to warn plaintiff of the hazard posed to her due and failed to properly inspect, maintain, and monitor to ensure that the metal ceiling access panel was properly secured.

The plaintiff seeks judgment against defendant for damages, as well as post-judgment interest, attorneys’ fees and costs, and further relief as the court deems just. She is represented by Michael A. Winkleman and Marc E. Weiner of Lipcon, Margulies, Alsina & Winkleman in Miami.
