Nemours Foundation accused of breaching contract with alleged refusal to sign lease

ORLANDO – An Orange County company alleges an Orlando nonprofit failed to sign a lease.

Elevation Development LLC filed a complaint on March 13 in 9th Judicial Circuit Court of Florida - Orange County against The Nemours Foundation alleging breach of contract.

According to the complaint, the plaintiff alleges that on Aug. 27, 2015, plaintiff entered into a letter of intent for a project for defendant to lease land and a building located in Winter Garden to be developed by the plaintiff. Plaintiff alleges it suffered damages for expending approximately $90,290 for the improvement of the property. The plaintiff holds The Nemours Foundation responsible because the defendant allegedly encouraged the plaintiff to expend monies and provide services towards the project while refusing to follow through with the project and to sign the lease.

The plaintiff requests a trial by jury and seeks damages of more than $15,000 plus interest, costs, attorney’s fees and for such other relief to which plaintiff may be entitled. It is represented by Robert Fox in Winter Park.
