Man alleges generator exploded, warranty claims were denied

ORLANDO – An Orange County resident alleges a warrantor failed to repair his generator.

Carl J. Fabry filed a complaint on March 13 in the 9th Judicial Circuit Court of Florida - Orange County against Generac Power Systems Inc., Central Florida Power Systems Inc. and David H. Shaver alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on July 2, 2014, he purchased a Generac 36 kilowatt Quiet Source Standby Generator from an authorized dealer. In November 2016, while defendant Shaver was attempting to repair the generator, it exploded, leaving it inoperable. 

The plaintiff holds Generac Power Systems Inc., Central Florida Power Systems Inc. and Shaver responsible because the defendants allegedly repeatedly denied plaintiff's warranty claims or by causing the generator to explode.

The plaintiff requests a trial by jury and seeks damages, prejudgment interest and such other relief that the court may deem just and necessary. He is represented by Christopher R. Turner of Christopher R. Turner PLLC in Orlando.
