Capio Partners alleged to have tried to collect debt that isn't due

TAMPA – A consumer claims a debt collector is attempting to collect a debt that had been settled.

Alan M. Schwartz filed a complaint on March 31 in the Tampa Division of Middle District of Florida against Capio Partners LLC alleging violation of the Fair Debt Collections Practices Act.

According to the complaint, the plaintiff alleges that on March 14, 2017, he suffered harm and damages from receiving a letter from the defendant in an attempt to collect upon a debt that was not due or was already settled in full, and even threatened to report plaintiff to the credit bureaus if he did not pay the discharged debt. The plaintiff holds Capio Partners LLC responsible because the defendant allegedly failed to state the principal amount of the debt, and attempted to collect an amount not authorized by law or the loan agreement.

The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, court costs, attorney's fees, and further relief that the court deems just. He is represented by Scott D. Stamatakis of Stamatakis + Thaiji + Bonanno in Tampa.
