Woman alleges Navient is unlawfully calling her to reach another person

Phone 03

TAMPA – A Tampa consumer alleges a debt collector called her more than 150 times to reach a different party.

Latisha Wilson filed a complaint on April 3 in the U.S. District Court for the Middle District of Florida against Navient Solutions LLC alleging that the debt collector violated the Telephone Consumer Protection Act and other counts.

According to the complaint, the plaintiff alleges that the defendant has called her with a frequency as can be reasonably expected to harass in its attempt to reach a different individual. The plaintiff holds Navient Solutions LLC responsible because the defendant allegedly interfered with plaintiff’s rights and interests in her cellular telephone and cellular telephone line, and caused placement of non-emergency telephone calls to plaintiff’s line using an ATDS or prerecorded or artificial voice without plaintiff’s prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory, punitive and actual damages, costs, interest, attorney's fees and any other such relief the court may deem just. She is represented by Stefan A. Alvarez and William Peerce Howard of The Consumer Protection Firm PLLC in Tampa.
