Woman alleges LTD Financial Services keeps calling for alleged debt that doesn't belong to her

ORLANDO – A Volusia County resident alleges a debt collector continues to call her for a debt that doesn't belong to her.

Ibet Toltowicz filed a complaint on March 30 in the U.S. District Court for the Middle District of Florida, Orlando Division against LTD Financial Services LP alleging violation of the Telephone Consumer Protection Act, the Florida Consumer Collection Practices Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in November 2016, the defendant contacted her using an automatic telephone dialing system and/or an artificial or prerecorded voice. She alleges the calls continued despite her repeated demands for the calls to stop and repeatedly informing defendant that the alleged debt it was attempting to collect was not hers. 

The plaintiff holds LTD Financial Services LP responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass.

The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, injunctive relief, costs of action, attorney's fees and other relief the court deems just. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
